1. Acceptance of Terms
By registering or using our services, you (“Trade Partner”) agree to be bound by this Agreement, including provisions covering Privacy, Payment, and Code of Conduct. "MRD" and "us" refer to Miller Resin Driveways.
2. The Service
We provide a platform and associated communications (website, apps, email, phone) to connect Trade Partners with customers seeking resin driveway services and related work. You, as the "Trade Partner," agree to have work enquiries provided via the Miller Resin Driveways web collective (social media and websites) sent directly to you via the chosen contact method.
3. Eligibility & Use
- You confirm legal authority and compliance to offer services in the UK.
- You may only use the Service for genuine customer inquiries and projects.
- You are responsible for adhering to laws, regulations, and industry standards.
4. Registration & Account
- You must provide accurate business details and keep them up to date.
- You’re responsible for safeguarding your account credentials and managing all activities under your account.
- You must provide a direct POC (point of contact) for Miller Resin Driveways to verify work.
5. Fees & Payments
- Usage may be free or subscription-based depending on plan levels.
- Fees and billing cycles will be communicated prior to activation.
- You are responsible for timely payments of any applicable fees.
- No refunds will be issued for non-performance or lack of customer engagement.
- Main basis of payment for jobs completed is on a COMMISSION BASIS – between 5% - 15%.
6. Customer Leads & Tenders
- We facilitate introductions to leads but do not guarantee any project awards.
- You are responsible for qualifying, negotiating, and conducting work with any leads received.
- We may suspend or revoke access for abuse, misuse, or breach of this Agreement.
- You must notify Miller Resin Driveways about the stages of a job and if you cannot proceed with work given. Failure to win a job means customer information is no longer owned by the Trade Partner and becomes the property of MRD to further pass on.
- A concierge service can be provided if requested for certain Trade Partners and Leads.
7. Conduct & Professionalism
- You must act lawfully, honestly, and professionally in all interactions.
- Harassment, defamation, or unlawful activity is prohibited.
- Provide correct licensing, qualifications, and insurance details as required.
- Report job progress to MRD up to completion.
- No slander or defamation against Miller Resin Driveways on Social Media or other platforms.
8. Liability & Indemnity
- You indemnify us for claims arising from your use of the Service or performance under third-party agreements.
- We carry no liability for delays, inaccuracies, or damages resulting from use of the platform, except where required by law.
- We are not liable as a sub-contractor due to the process of how works and Trade Partners are paid/completed.
9. Intellectual Property
- You grant us a non-exclusive licence to display your business details on our platform.
- You retain ownership of your branding, content, and logos.
- You give the right to use Trade Partner content as seen on websites, social media, and content funnels on our web platforms.
10. Privacy & Data Use
- You agree to our Privacy Policy concerning how personal data is processed.
- You will only use customer data for valid project-related communication.
- GDPR and UK data protection compliance is required.
11. Disclaimers
- We provide the Service “as is” without warranties of accuracy, uptime, or error-free operation.
- We disclaim liability for indirect losses, except in cases of death, personal injury, or fraud.
12. Suspension & Termination
- We may suspend or terminate your participation if you breach this Agreement.
- You may terminate your account at any time; obligations and fees incurred before termination remain payable, if any.
13. Amendments
- We may update this Agreement at any time; changes are effective four business days after notice unless you object. Continued use constitutes acceptance of new terms.
14. General
- Governing law: England & Wales.
- Jurisdiction: Courts of England & Wales.
- This document and its annexes constitute the entire agreement.
Homeowner Terms of Use & Data Consent Agreement
Miller Resin Driveways
1. Acceptance of Terms
By using our services or submitting an enquiry, you (“Homeowner”) or ("Customer") agree to the terms of this agreement and grant Miller Resin Driveways the right to manage and process your information for the purpose of matching you with qualified trade professionals. "MRD" and "us" refer to Miller Resin Driveways.
2. Our Service
We connect homeowners (customers) with verified, independent resin driveway installers and related home improvement professionals across the UK. You provide basic project and contact information, and we help facilitate introductions to suitable local providers.
3. Consent to Share Information
By submitting a project or request, you expressly agree that:
- Your name, contact details, project information, and relevant property details may be shared securely with selected trade professionals for quotes, assessments, or arranging services.
- These tradespeople may contact you directly to discuss your project.
- We will only share your details with vetted and relevant professionals.
- You may request at any time for your details to be withheld or deleted.
4. Data Use & Protection
- We handle your information in accordance with UK GDPR and Data Protection laws.
- Your data is stored securely and only accessed by authorised personnel.
- We do not sell or publicly publish your personal information.
- You can request access to, correction of, or deletion of your data at any time.
5. No Guarantee of Service
While we aim to connect you with reliable trade professionals, we do not guarantee that any particular service will be offered, accepted, or completed. All agreements are made directly between you and the Trade Partner.
6. Liability Disclaimer
Miller Resin Driveways acts only as an introducer. We are not responsible for the conduct, performance, or outcomes of any work arranged between you and any third-party Trade Partner.
- Should you have a dispute with a Trade Partner, you must address it directly with the Trade Partner. However, you agree to notify us as soon as reasonably practicable.
- We may investigate grievances and discuss findings with all involved parties. Potential outcomes include:
- Continuation of service for both parties;
- Suspension of access for a period of time;
- Termination and banning of access for a definite or indefinite period.
7. Your Responsibilities
- Provide accurate and honest information about your project.
- Treat Trade Partners with respect and respond to communications promptly.
- Notify us if you experience any issues with a referred Trade Partner.
8. Changes to This Agreement
We may update this agreement periodically. Material changes will be communicated, and continued use of the service after updates constitutes acceptance.
Governing Law: England & Wales
Jurisdiction: Courts of England & Wales
Both Trade Partners and Homeowners acknowledge that Miller Resin Driveways may provide links or referrals to third-party services, but MRD is not responsible for the content, reliability, or actions of those third parties. All communications, notifications, or agreements delivered electronically (email, website messages, or forms) are considered legally binding. In the event of circumstances beyond our reasonable control, including but not limited to natural disasters, technical failures, or third-party disruptions, MRD shall not be held liable for delays, interruptions, or failures to provide the Service. Any disputes arising under this Agreement should be addressed promptly in good faith, and MRD may, at its discretion, facilitate resolution between parties.
